{"id":1172,"date":"2017-04-03T11:02:13","date_gmt":"2017-04-03T15:02:13","guid":{"rendered":"https:\/\/law.temple.edu\/ejc\/?p=1172"},"modified":"2021-11-23T19:08:42","modified_gmt":"2021-11-23T19:08:42","slug":"guest-post-border-security-interior-enforcement","status":"publish","type":"post","link":"https:\/\/law.temple.edu\/ejc\/2017\/04\/03\/guest-post-border-security-interior-enforcement\/","title":{"rendered":"Guest post: border security and interior enforcement"},"content":{"rendered":"<p style=\"text-align: left\"><em>Guest blogger Anne Bonfiglio, a second-year student at Temple Law, shares her reflections on last week&#8217;s Sheller-Center-sponsored panel (the first in our &#8220;Making Sense of the Legal Headlines&#8221; series).<\/em><\/p>\n<p>Midway through the Q&amp;A of last week\u2019s panel on Border Security and Interior Enforcement, a student prefaced a question with the comment, \u201cthis is really depressing.\u201d\u00a0 Exiting the event, a professor confessed that only seconds before that remark a colleague had whispered the same to her.\u00a0 For those who care about the rights of immigrants, January\u2019s executive orders certainly are disheartening.\u00a0 For those in the country without status, they are terrifying.\u00a0 But I left with a more hopeful takeaway: these orders are vulnerable in the face of resistance.<\/p>\n<p>The lecture, given by Professors Ramji-Nogales and Spiro, focused on the two Executive Orders signed January 25, 2017.\u00a0 The first, \u201cBorder Security and Immigration Enforcement Improvements,\u201d orders the construction of the infamous border wall.\u00a0 The second, \u201cEnhancing Public Safety in the Interior of the United States,\u201d attacks \u201csanctuary jurisdictions\u201d by removing their eligibility for Federal grants. \u00a0Additionally, these orders authorize an expansion of detention facilities, expedited removal, and immigration officer hiring, expand the definition of a criminal alien, and require the publication of data supporting the President\u2019s anti-immigrant position.<\/p>\n<p>On their face, these provisions are alarming.\u00a0 Unfortunately, some, such as the expansion of expedited removal, are well within the President\u2019s statutory authority (though they may present constitutional questions).\u00a0 But others are less secure.\u00a0 Some provisions, including increased hiring, detention, and the wall, are subject to Congressional budgetary approval.\u00a0 Others, like the various reporting obligations, have inadequate infrastructure. \u00a0And the crackdown on sanctuary jurisdictions has at least three possible legal arguments against it: precedents prohibiting the commandeering of local law enforcement, constraining the use of funding to force compliance, and basic Fourth Amendment Protections.<\/p>\n<p>While these orders have yet to be challenged in court, they can be resisted, whether through lawsuits or local community support of undocumented residents.\u00a0 As an immigrants\u2019 rights advocate, I find inspiration in these possibilities.\u00a0 Yes, recent policy is depressing and the toll on families is staggering.\u00a0 But it is important that one doesn\u2019t become overwhelmed by these costs.
