{"id":3606,"date":"2022-10-24T20:58:01","date_gmt":"2022-10-24T20:58:01","guid":{"rendered":"https:\/\/law.temple.edu\/aer\/?p=3606"},"modified":"2022-10-24T20:58:01","modified_gmt":"2022-10-24T20:58:01","slug":"persuasion-science-for-trial-lawyers","status":"publish","type":"post","link":"https:\/\/law.temple.edu\/aer\/2022\/10\/24\/persuasion-science-for-trial-lawyers\/","title":{"rendered":"PERSUASION SCIENCE FOR TRIAL LAWYERS"},"content":{"rendered":"<p>Is trial advocacy art, science, or some of each?\u00a0 The answer is definitely the third, although the science part often gets lost in the shuffle or is alleged science with no data to back it up [think {80% of juries decide the case after opening\u201d or \u201ca picture plus words causes 60% fact retention\u201d].\u00a0 Finding the true science for persuasion takes some work but pays off grandly.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-3607 aligncenter\" src=\"https:\/\/law.temple.edu\/aer\/wp-content\/uploads\/sites\/5\/2022\/10\/Screenshot-2022-10-24-at-16-55-48-Persuasion-Science-for-Trial-Lawyers-John-P.-Blumberg-Free-Shipping-202x300.png\" alt=\"\" width=\"202\" height=\"300\" srcset=\"https:\/\/law.temple.edu\/aer\/wp-content\/uploads\/sites\/5\/2022\/10\/Screenshot-2022-10-24-at-16-55-48-Persuasion-Science-for-Trial-Lawyers-John-P.-Blumberg-Free-Shipping-202x300.png 202w, https:\/\/law.temple.edu\/aer\/wp-content\/uploads\/sites\/5\/2022\/10\/Screenshot-2022-10-24-at-16-55-48-Persuasion-Science-for-Trial-Lawyers-John-P.-Blumberg-Free-Shipping.png 231w\" sizes=\"auto, (max-width: 202px) 100vw, 202px\" \/><\/p>\n<p>&nbsp;<\/p>\n<p>Efforts abound \u2013 trial advocacy texts now include a chapter on brain science; lecturers discuss seminal works such as <em>Thinking Fast and Slow:<\/em> and blogs on brain science, cognitive psychology and the courtroom try to fill the gap. \u00a0Words like \u201cdopamine\u201d and \u201con the same wavelength [neural coupling\u201d] are in our vocabulary and teaching slides. \u00a0But to get a full picture, if there is but one book any trial lawyer or trial skills teacher should read this year, it is John Blumberg\u2019s <em>Persuasion Science for Trial Lawyers<\/em>.\u00a0 Reviews that begin in such a manner are often exaggerated or unreliable, but here the label fits.<\/p>\n<p>Let me begin with who the author is &#8211; a trial lawyer and triple-board certified practitioner with extensive involvement in the National Board of Trial Advocacy and the American Board of Trial Advocates.\u00a0 More importantly, he is a lawyer who decided to search out the science of persuasion to inform the part of trial advocacy that is, indeed, science; and he undertook this with a thoroughness that demands attention.<\/p>\n<p>What does <em>Persuasion Science<\/em> offer?\u00a0 After some introductory chapters it dives, deeply, into the world of psychology as applied or applicable to litigation and trials.\u00a0 It begins in a place we talk about too little &#8211; collegiality and the pre-trial relationship with opposing counsel \u2013 and makes the convincing case that adversarial hostility is detrimental to securing a beneficial outcome.\u00a0 Allowing the opponent to save face, and using the technique of \u201cgiving in to get your way,\u201d are guideposts for successful negotiation, a point confirmed by recent research.\u00a0 <em>See, e.g.<\/em> <a href=\"https:\/\/law.temple.edu\/aer\/2020\/12\/03\/brain-lessons-negotiating-errors-when-the-adversarial-mindset-hurts-more-than-helps\/\">https:\/\/law.temple.edu\/aer\/2020\/12\/03\/brain-lessons-negotiating-errors-when-the-adversarial-mindset-hurts-more-than-helps\/<\/a><\/p>\n<p>When it turns to the courtroom <em>Persuasion Science<\/em> is at its best and to some most unsettling.\u00a0 Blumberg does not abide by all conventional reasoning \u2013 he follows the science and comes to a number of conclusions that might seem provocative if not scary.\u00a0 Consider this one:<\/p>\n<p>People are usually more convinced by rea\u00adsons they discovered themselves than by those found out by others. By enticing the jurors to fill in the missing infor\u00admation, they will reach the desired conclusions. If you tell them, they will resist; but when they arrive at their own con\u00adclusion, it sticks because they have persuaded themselves.<\/p>\n<p><em>Persuasion Science, <\/em>56.\u00a0 Imagine a closing argument where the advocate does not say \u201cthe evidence <em>demands<\/em> a finding of\u2026\u201d but instead hands that to the jurors with a soft \u201ccould those be the result of carelessness\u2026?\u201d<\/p>\n<p>This lesson is part of a broader one about \u201creactance.\u201d\u00a0 The author explains this in detail, with a personal experience driving it home:<\/p>\n<p>Reactance is the resistance to something that is perceived as a threat to one\u2019s autonomy or freedom of choice. Words like \u201cmust,\u201d \u201cshould,\u201d and \u201cneed\u201d are known reactance triggers. I learned this lesson during a mock trial. I was going through the verdict form and told the jurors how the questions should be answered. I had noticed that a young woman juror was paying close attention. I thought that I must have been very persuasive. Shortly afterward, while I observed deliberations on a remote monitor, I was stunned when she said, \u201cCan you believe that douchebag plaintiff lawyer telling us what to do?\u201d<\/p>\n<p><em>Persuasion Science, <\/em>91.\u00a0 The book is replete with more lessons, some more familiar and\/or less threatening:<\/p>\n<ul>\n<li>The use of visuals to supplement oral testimony is not limited to the role of pictures reinforcing words. Blumberg explains that memory processes visuals and words in two different \u201cchannels,\u201d each with limited capacity.\u00a0 Using the visuals reduces the need for words, making each channel more efficient and productive.\u00a0 And learning comes when the two channels are not competing \u2013 show the picture or read the words, not simultaneously.\u00a0 And if you have to show a visual with words \u2013 STAY SILENT.\u00a0 If you read the words aloud as jurors try to read along, it reduces comprehension.\n<ul>\n<li>A related consideration is the age of the audience [juror]. As aging occurs, the efficacy of words may diminish but not so for pictures.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<ul>\n<li>Don\u2019t expect rational arguments to generate the emotional state required for a juror to support your position; rather,<\/li>\n<\/ul>\n<p>it is the emotional part that results in a <em>feeling <\/em>that causes the rational brain to justify a decision. <em>Caring <\/em>is <em>emo\u00adtional<\/em>. <em>Self-interest <\/em>is <em>emotional<\/em>. <em>Empathy <\/em>is <em>emotional<\/em>. By using techniques that stimulate emotions, the rational brain finds the reasons to justify how the listener <em>feels<\/em>.<\/p>\n<p><em>Persuasion Science, <\/em>48.<\/p>\n<ul>\n<li>Link factual depictions to the five senses \u2013 including what was smelled, heard and seen creates a more powerful, engaging and lasting image.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<ul>\n<li>Engender curiosity. If you begin an opening statement with a concern such as a child left at home, alone, with an unsecured firearm and pose the rhetorical question \u201cimagine what might happen to that child\u201d listeners want to know what the outcome is, predict what it might be, and then listen for whether their prediction is proved true.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<ul>\n<li>Using \u201cdevil\u2019s advocate\u201d questions in jury selection can be a powerful tool to begin developing juror allegiance to your position and the inclination to argue that point on your client\u2019s behalf. An example would be asking jurors not whether corporations should be held responsible for their employees\u2019 actions but, instead, along thee lines of \u2018because corporations are responsible for lots of people and decisions and have lots of managers, is there any reason why a corporation should be responsible when an employee causes a harm?\u00a0 [The book does hits much more artfully \u2013 the example merely illustrates the proposition.]<\/li>\n<\/ul>\n<p>Added value comes in samples from arguments the author has developed.\u00a0 Here is an exceptional one:<\/p>\n<p>A powerful analogy might help defeat an argument that the absence of a prior accident is proof that there was no danger:<\/p>\n<p>Allowing a dangerous condition to exist is like Rus\u00adsian roulette. In Russian roulette, the cylinder of a six-shooter is spun, and then the trigger is pulled. If nothing bad happens the first five times, that doesn\u2019t mean it\u2019s safe. It\u2019s only a matter of time.<\/p>\n<p>Other valuable insights are found in the chapter on experts, particularly on how to transform an expert\u2019s dry recitation of facts into the telling of a story.\u00a0 And Blumberg counsels us to use juror curiosity in establishing the expert\u2019s qualifications \u2013 asking the witness <em>why<\/em> they are able to give an opinion or otherwise assist the jury is being responsive to what jurors are asking themselves, albeit in the form of \u2018so why should I listen to this person?\u2019<\/p>\n<p>These are but a few of the lessons provided by <em>Persuasion Science<\/em>, a book amply annotated so that readers can \u2018go to the source.\u201d \u00a0Use it to distinguish \u201cempathy\u201d from \u201csympathy\u201d or to reconsider whether rapid-fire, staccato cross-examination is jury friendly or actually impedes comprehension. \u00a0It is no surprise that the book is covered with tributes \u2013 and it is a text that warrants repeated readings and a prominent place on the advocate\u2019s bookshelf.<\/p>\n<p>&nbsp;<\/p>\n<p><em>Information on PERSUASION SCIENCE<\/em> <em>can be found at <\/em><a href=\"https:\/\/www.persuasion-science.com\/\"><em>https:\/\/www.persuasion-science.com\/<\/em><\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Is trial advocacy art, science, or some of each?\u00a0 The answer is definitely the third, although the science part often gets lost in the shuffle or is alleged science with no data to back it up [think {80% of juries decide the case after opening\u201d or \u201ca picture plus words causes 60% fact retention\u201d].\u00a0 Finding<\/p>\n","protected":false},"author":31,"featured_media":0,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"generate_page_header":"","_jetpack_memberships_contains_paid_content":false,"footnotes":""},"categories":[5],"tags":[],"coauthors":[330],"class_list":["post-3606","post","type-post","status-publish","format-standard","hentry","category-brain-lessons"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.2 -
