But read on \u2013 what goes first at trial may not always determine outcome.<\/p>\n<p>The importance of ordering is known well beyond the courtroom and is the starting place for much of cognitive psychology.\u00a0 It is proved in the simplest of ways.<\/p>\n<p>Test yourself:\u00a0 start at the left with the below picture, and read aloud.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-3518 aligncenter\" src=\"https:\/\/law.temple.edu\/aer\/wp-content\/uploads\/sites\/5\/2022\/05\/AB-2-300x125.jpg\" alt=\"\" width=\"300\" height=\"125\" srcset=\"https:\/\/law.temple.edu\/aer\/wp-content\/uploads\/sites\/5\/2022\/05\/AB-2-300x125.jpg 300w, https:\/\/law.temple.edu\/aer\/wp-content\/uploads\/sites\/5\/2022\/05\/AB-2.jpg 732w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><\/p>\n<p>&nbsp;<\/p>\n<p>Presumably, you read \u201cA, B.\u201d<\/p>\n<p>Now, start at the right and read aloud.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-3519 aligncenter\" src=\"https:\/\/law.temple.edu\/aer\/wp-content\/uploads\/sites\/5\/2022\/05\/a-b-13-14-2-300x120.jpg\" alt=\"\" width=\"300\" height=\"120\" srcset=\"https:\/\/law.temple.edu\/aer\/wp-content\/uploads\/sites\/5\/2022\/05\/a-b-13-14-2-300x120.jpg 300w, https:\/\/law.temple.edu\/aer\/wp-content\/uploads\/sites\/5\/2022\/05\/a-b-13-14-2-768x307.jpg 768w, https:\/\/law.temple.edu\/aer\/wp-content\/uploads\/sites\/5\/2022\/05\/a-b-13-14-2.jpg 770w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><\/p>\n<p>Predictably, you would read \u201c14, 13.\u201d<\/p>\n<p>Now, see the \u2018whole picture.\u2019<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-3517 aligncenter\" src=\"https:\/\/law.temple.edu\/aer\/wp-content\/uploads\/sites\/5\/2022\/05\/a-b-13-14-e1651509048956-300x81.png\" alt=\"\" width=\"537\" height=\"145\" srcset=\"https:\/\/law.temple.edu\/aer\/wp-content\/uploads\/sites\/5\/2022\/05\/a-b-13-14-e1651509048956-300x81.png 300w, https:\/\/law.temple.edu\/aer\/wp-content\/uploads\/sites\/5\/2022\/05\/a-b-13-14-e1651509048956-1024x278.png 1024w, https:\/\/law.temple.edu\/aer\/wp-content\/uploads\/sites\/5\/2022\/05\/a-b-13-14-e1651509048956-768x208.png 768w, https:\/\/law.temple.edu\/aer\/wp-content\/uploads\/sites\/5\/2022\/05\/a-b-13-14-e1651509048956.png 1139w\" sizes=\"auto, (max-width: 537px) 100vw, 537px\" \/><\/p>\n<p>&nbsp;<\/p>\n<p>Nothing has changed with the middle character.<\/p>\n<p>What brought this to mind?\u00a0 A recent (February 17) lecture by Itiel Dror \u2013 \u201cImproving Forensic Decision Making: a Human-Cognitive Perspective discussed the importance of \u201clinear sequential unmasking.\u201d\u00a0 [You can see the lecture and a posted article at <a href=\"https:\/\/forensicstats.org\/blog\/portfolio\/improving-forensic-decision-making\/\">https:\/\/forensicstats.org\/blog\/portfolio\/improving-forensic-decision-making\/<\/a> ]<\/p>\n<p>The gist is simple \u2013 when a fingerprint examiner or other analyst performs their work, they should get data in a particular order to avoid any information that might distort the analysis. \u00a0An analyst should not be told \u201cthe suspect confessed\u201d before seeing if their prints match those from the crime scene, as the result will be to look for matching features and possibly ignore those that vary.\u00a0 More generally, examiners are now taught to look at the print lifted from the crime scene and identify its salient features <em>before<\/em> looking at the suspect\u2019s exemplar, because if they proceed in the opposite order the analyst may be looking for what they hope to find.<\/p>\n<p>But this article is about courtroom ordering, not crime labs.\u00a0 What\u2019s the link?\u00a0 During the February lecture, Dr. Dror referenced an article published more than fifty years ago, Lawson, Order of Presentation as a Factor in Jury Persuasion, 56 KY. L.J. 523 (1968).\u00a0 He cited it as a work showing that the idea that order counts is true in many places, even the courtroom.<\/p>\n<p>In this article, Lawson was particularly concerned about criminal trials where the prosecution had both the primacy (first opening) and recency (final closing words) advantage.\u00a0 Based on the research extant in 1968, Lawson posited the following regarding jury trials: \u201cIt is possible to predict with a reasonably high degree of confidence that \u2018primacy effects\u2019 do influence the decisions of jurors.\u201d\u00a0 Lawson found a study showing how primacy\u2019s power might be offset &#8211; warning decision makers of the risk of being over-persuaded by a first impression had some success in reducing the primacy effect.\u00a0 Lawson then concluded with a question \u2013<\/p>\n<p style=\"padding-left: 40px\">\u201cIs the deliberation process of jurors, as it is presently conceived, frustrated as a consequence of the unbalanced effectiveness of persuasive communications resulting from the order in which they are presented?\u201d<\/p>\n<p>Intrigued, my goal was to follow up on Lawson.\u00a0\u00a0 The most recent article to cite Lawson is Engel, Timme, and Glockner, <strong><em>Coherence-Based Reasoning and Order Effects in Legal Judgments<\/em><\/strong>, 26 Psych. Pub. Pol. and L. 333 (2020).\u00a0 It\u2019s research and conclusions were surprising.<\/p>\n<p>\u201cCoherence\u201d is a concept familiar to all who teach the importance of story-telling \u2013 the story gives the framework [here, the \u201ccoherence\u201d] to the discrete facts that are presented at trial.\u00a0 Simply, if the opening statement provides a story board framework that the listener adopts, then facts presented at trial will be made coherent when they fit the story and rejected, or minimized, or explained away when they don\u2019t.<\/p>\n<p>Engle and colleagues look at the interplay between coherence-based reasoning and the order of evidence presentation.\u00a0 It asks a basic question \u2013 if primacy is what generates the story, does primacy drive coherence drive verdict? One might expect the answer to be yes, especially after Lawson\u2019s work.\u00a0 The answer, at least from the experiments the researchers conducted, is a surprising \u201cno.\u201d<\/p>\n<p>How was this tested?\u00a0 Test subjects all reviewed the same case study:<\/p>\n<p style=\"padding-left: 40px\">[A] company accused one of its employees of having stolen money from the company safe. The evidence consisted of 12 pieces of information (6 facts and 6 background beliefs). The money was stolen using the regular access code, which only a few persons had. The money was stolen in the evening and the time was recorded. Important proguilty [incriminating] facts were the low number of persons who knew the access code for the safe from which the money was stolen, and the high confidence level of an eyewitness who, afterward, reported having seen the defendant at the site of the crime.<\/p>\n<p style=\"padding-left: 40px\">The strongest con-guilty [exculpatory] fact was that the defendant was seen shortly after the moment of the crime in a place that was hard to reach in such a short time.<\/p>\n<p>26 Psych. Pol. at 336.<\/p>\n<p>There were four groups \u2013 two received the pro-guilty evidence first; and the other received a \u201cbalanced\u201d accounting of the case.\u00a0 One group from each condition \u2013 pro-guilty and balanced \u2013 was also asked a question before receiving the balance of the evidence:<\/p>\n<p style=\"padding-left: 40px\">You have now received half of the evidence for the case. Please take a bit of time to think about the case. Toward which judgment would you lean, based on the available evidence? Your leaning is, of course, not binding, and you can decide differently after you have seen the remaining evidence. I lean toward thinking (a) that Hans H. is guilty of committing the crime versus (b) Hans H. is not guilty.<\/p>\n<p><em>Id.<\/em><\/p>\n<p>Not surprisingly, those who saw only proguilty evidence had strong leanings toward conviction at the halfway point of this mock trial. But that impact was not enduring.\u00a0 Here are the results at the end of the trials, when the mock jurors had received the entire set of facts.\u00a0 \u201cPresenting proguilty evidence first and con-guilty evidence last led to 32% convictions, as compared to 40% with a balanced presentation.\u201d\u00a0 <em>Id., <\/em>337. In other words, what jurors learned last had more of an impact than what they heard first.<\/p>\n<p>There was more.\u00a0 The authors predicted that the early, primacy-driven conclusions of mock jurors would only magnify and entrench through the course of the trial. \u00a0The results crushed that prediction. \u00a0\u201cThere was no support for our second hypothesis: we had predicted that primacy effects would be amplified (and recency effects reduced) after an initial leaning.\u201d\u00a0 <em>Id.<\/em> In other words, asking people where their heads were at midway through trial did not, even coupled with primacy, lead to more convictions.<\/p>\n<p>Are there takeaways from this?\u00a0 I find at least three.\u00a0 First, the primacy-coherence connection does exist and operates in some areas of persuasion, such as consumer choice.\u00a0 This means that as much as lawyers should look to studies in other sectors they don\u2019t always transfer to the courtroom.\u00a0 Second, primacy and coherence still count \u2013 they just don\u2019t control.\u00a0 Finally, that last word [recency] may be where the real courtroom power lies.<\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The power of ordering \u2013 where you place a fact or argument \u2013 should be beyond question.
