The jurors really, really despise repetition, because they feel like you\u2019re talking down to them. They feel like you think they\u2019re stupid if you keep repeating matters over and over.<\/p>\n<p style=\"padding-left: 40px\">Here are some examples of what they said:<\/p>\n<p style=\"padding-left: 80px\">\u201cRepeating of the question 304 times\u201d<\/p>\n<p style=\"padding-left: 80px\">\u201cRepeated the same thing over and over.\u201d<\/p>\n<p style=\"padding-left: 80px\">\u201cStop asking the same questions over and over.\u201d<\/p>\n<p style=\"padding-left: 80px\">\u201cLots of repeating, same thing\u2014okay, we get it.\u201d<\/p>\n<p style=\"padding-left: 80px\">\u201cWould like to see attorneys question the witness without repeating the<\/p>\n<p style=\"padding-left: 80px\">same question three different ways and then summarizing.\u201d<\/p>\n<p style=\"padding-left: 80px\">\u201cThe lawyers constantly rephrasing sucks.\u201d<\/p>\n<p style=\"padding-left: 40px\">So the jurors get it. You don\u2019t have to ask the same questions and you shouldn\u2019t ask the same things over and over. Again, they feel like you\u2019re talking down to them. That you think they\u2019re stupid if you keep asking the same thing over and over. And back to the other common theme, you\u2019re wasting their time. They don\u2019t like their time wasted.<\/p>\n<p style=\"padding-left: 40px\">So you should ask clear and relevant questions. They don\u2019t like lengthy, compound, or convoluted questions; they like short, clear, and easy to understand questions.<\/p>\n<p>The Honorable Amy J. St. Eve, <strong>WHAT JURIES REALLY THINK: PRACTICAL GUIDANCE FOR FUTURE TRIAL LAWYERS, 89 Fordham La.Rev. 2623, 2630 (2021).<\/strong><\/p>\n<p>Yet lawyers can\u2019t resist.\u00a0 In one post-conviction case, trial counsel was asked why he questioned the detective who interrogated counsel\u2019s client, a cross-examination that elicited only extremely damaging information including the belief that the client was lying.\u00a0 Counsel\u2019s response (verbatim from the transcript)? \u00a0\u201cThat\u2019s what they said to me when he was finished testifying, do you have any cross-examination?\u00a0 And I thought I better do some.\u201d\u00a0 N.T. 12\/27\/2004, 56-57.<\/p>\n<p>So it was with some relief that I read the news coverage of the Ghislaine Maxwell trial.\u00a0 When the defense team called a co-worker to say that Maxwell and financier\/predator Jeffrey Epstein had growon apart and spent little time together at work, the prosecution cross was a pristine one, the bext example possible of \u201cless <em>is<\/em> more.\u201d\u00a0 As reported by NPR, \u201cthe prosecution simply asked, did you ever work at Jeffrey Epstein&#8217;s home in New York or Palm Beach? Espinosa responded, no. And the prosecution said, no further questions, which elicited some laughs in the courtroom.\u201d<\/p>\n<p><a href=\"https:\/\/www.npr.org\/2021\/12\/16\/1065002055\/defense-attorneys-called-their-first-witnesses-in-the-trial-for-ghislaine-maxwel\">https:\/\/www.npr.org\/2021\/12\/16\/1065002055\/defense-attorneys-called-their-first-witnesses-in-the-trial-for-ghislaine-maxwel<\/a> (last visited 12\/21\/21).<\/p>\n<p>It is no laughing matter \u2013 but the one question cross is indeed a lesson for all of us.\u00a0 What could be more effective &#8211; one question confirmed the witness&#8217; complete lack of familiarity with what went on outside of the workplace.\u00a0 Make your point and sit down \u2013 the jury gets it.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Despite familiarity with the phrase \u201cless is more,\u201d lawyers can\u2019t seem to help themselves \u2013 they ask question after question after question.
