{"id":2879,"date":"2020-12-03T19:58:48","date_gmt":"2020-12-04T00:58:48","guid":{"rendered":"https:\/\/www2.law.temple.edu\/aer\/?p=2879"},"modified":"2021-12-16T14:56:31","modified_gmt":"2021-12-16T14:56:31","slug":"brain-lessons-the-persuasive-voice","status":"publish","type":"post","link":"https:\/\/law.temple.edu\/aer\/2020\/12\/03\/brain-lessons-the-persuasive-voice\/","title":{"rendered":"BRAIN LESSONS: THE PERSUASIVE VOICE"},"content":{"rendered":"<p>I [Grant] have been teaching again in my Advanced Trial Advocacy class on Patsy Rodenburg\u2019s book, <em>The Second Circle<\/em>, and decided this month that I would dovetail a bit with Jules\u2019s excellent post last month on how the voice persuades.<a href=\"#_ftn1\" name=\"_ftnref1\">[1]<\/a>\u00a0 While this month\u2019s post isn\u2019t necessarily about <em>new<\/em> research, my hope is that you find it \u201cnew-to-you\u201d and of some use to you as you as a professor, coach, or advocate.<\/p>\n<p>For some background, Patsy Rodenburg, a rather famous acting coach, proposed the idea that people work, speak, breathe, teach, persuade, and live in one of what she calls the \u201cthree circles of energy.\u201d\u00a0 The first circle of energy is an energy that \u201cfalls back into you\u201d and never really leaves your orbit. \u00a0Patsy Rodenburg, <em>The Second Circle <\/em>16 (2<sup>nd<\/sup> ed. 2017).\u00a0 First circle energy can be sullen, contemplative, indifferent, subdued, or selfish. \u00a0By contrast, the third circle of energy is an energy that pushes out from you and into, or even right through, others.\u00a0 It can be aggressive, arrogant, controlling, overly enthusiastic, or falsely positive.\u00a0 It\u2019s energy that leaves your orbit and is pushed out of you, propelled by your will.\u00a0 The second circle of energy, however, is the energy of <strong><em>presence<\/em><\/strong>.\u00a0 It\u2019s defined by a mutual exchange of energy between you and another, or you and a group, or even you and an object\u2014like an instrument you\u2019re playing\u2014in which you\u2019re devoting your energy to the living moment and receiving energy back from that person or thing in the moment with you.\u00a0 Each circle of energy has its place, but it\u2019s the second circle where we give the most to life and receive the most from it.\u00a0 <em>Id. <\/em>at xiv.<\/p>\n<p>In her book, Rodenburg writes extensively about the voice, how it reveals which circle it\u2019s emanating from, and that recalls to my mind last month\u2019s post about how the voice persuades.\u00a0 If you hear a first circle voice, one that sounds indifferent, sullen or detached, do you find yourself moved by it or do you find it saps your energy? By contrast, a third circle voice projects energy out like a steamroller.\u00a0 Have you really felt moved by a speaker who\u2014with his shoulders pulled back and head high\u2014tried to persuade you to think a certain way using ear-splitting volume and the insistence of his demands on you? \u00a0He might actually hold your attention, but are you really interacting with his ideas or just riding along on his wave?<\/p>\n<p>If last month\u2019s post was about how the brain responds to things like timbre, volume, pitch, etc., then this month\u2019s post is simply to frame the personal context for <em>why<\/em> a persuasive voice moves us.\u00a0 For Rodenburg, it\u2019s this: a second circle voice is the voice of intimacy, equality, and connection, and our brain likes those things. See <em>Id. <\/em>at 79-82. When we see a student glued to her notes on opening statement, we inevitably hear a first circle voice.\u00a0 When you have a student shouting into the wall behind his jury, demanding a conviction, you hear a third circle voice.\u00a0 But if you\u2019ve had a conversation with a student or colleague where the exchange of ideas and energy was equal, you likely still remember it.\u00a0 You can recall the feelings you had in those moments.\u00a0 You remember feeling <em>engaged<\/em> and feeling as though you were also <em>engaging<\/em>.\u00a0 That is the second circle.\u00a0 For the students we have who crawl inside their notes or bully their way through a closing argument, Rodenburg encourages us to reveal to them their most persuasive self\u2014who they are when they are actually present with their audience and speaking in second circle energy.<\/p>\n<p><a href=\"#_ftnref1\" name=\"_ftn1\">[1]<\/a> I want to give credit here to Rafe Foreman, attorney and instructor at Gerry Spence\u2019s Trial Lawyer\u2019s College, for turning me on to Patsy Rodenburg\u2019s work and writing.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>I [Grant] have been teaching again in my Advanced Trial Advocacy class on Patsy Rodenburg\u2019s book, The Second Circle, and decided this month that I would dovetail a bit with Jules\u2019s excellent post last month on how the voice persuades.[1]\u00a0 While this month\u2019s post isn\u2019t necessarily about new research, my hope is that you find<\/p>\n","protected":false},"author":31,"featured_media":0,"comment_status":"closed","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"generate_page_header":"","_jetpack_memberships_contains_paid_content":false,"footnotes":""},"categories":[5,11],"tags":[],"coauthors":[203],"class_list":["post-2879","post","type-post","status-publish","format-standard","hentry","category-brain-lessons","category-trial-advocacy"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.2 -
