{"id":2675,"date":"2020-05-04T14:19:37","date_gmt":"2020-05-04T18:19:37","guid":{"rendered":"https:\/\/www2.law.temple.edu\/aer\/?p=2675"},"modified":"2021-12-16T14:56:57","modified_gmt":"2021-12-16T14:56:57","slug":"narrative-or-story-know-the-difference","status":"publish","type":"post","link":"https:\/\/law.temple.edu\/aer\/2020\/05\/04\/narrative-or-story-know-the-difference\/","title":{"rendered":"Narrative or Story &#8211; Know The Difference"},"content":{"rendered":"<p>I suspect that many if not most lawyers are unaware of \u201cnarratology,\u201d defined as \u201cthe study of structure in narratives\u201d (<a href=\"https:\/\/www.merriam-webster.com\/dictionary\/narratology\">https:\/\/www.merriam-webster.com\/dictionary\/narratology<\/a>, last visited April 5, 2020) or \u201ca humanities discipline dedicated to the study of the logic, principles, and practices of narrative representation\u2026\u201d (<a href=\"https:\/\/www.lhn.uni-hamburg.de\/node\/48.html\">https:\/\/www.lhn.uni-hamburg.de\/node\/48.html<\/a>, last visited April 5, 2020).\u00a0 Yet a definition that itself uses the root word is not that helpful; and for lawyers what we need to know is how this study can inform what we do, particularly in opening statements but also throughout our advocacy.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-2676 aligncenter\" src=\"https:\/\/law-dev.temple.edu\/aer\/wp-content\/uploads\/sites\/3\/2020\/04\/narratology-4-14-20-200x300.jpg\" alt=\"\" width=\"200\" height=\"300\" srcset=\"https:\/\/law.temple.edu\/aer\/wp-content\/uploads\/sites\/5\/2020\/04\/narratology-4-14-20-200x300.jpg 200w, https:\/\/law.temple.edu\/aer\/wp-content\/uploads\/sites\/5\/2020\/04\/narratology-4-14-20.jpg 333w\" sizes=\"auto, (max-width: 200px) 100vw, 200px\" \/><\/p>\n<p>Porter Abbott\u2019s THE CAMBRIDGE INTRODUCTION TO NARRATIVE, 2<sup>ND<\/sup> EDITION (Cambridge University Press, 2008) begins with the point that, next to language itself, narrative is the \u201cdistinctive\u201d human trait. Porter then teaches the following:<\/p>\n<ul>\n<li>A story is the series of events at issue, while narrative is the story \u201cmediated\u201d through how the teller presents it, <em>e.<\/em>, through \u201cnarrative discourse. Abbott, 21.<\/li>\n<li>Humans have the \u201ctendency to insert narrative into static, immobile scenes\u2026\u201d Abbott, 7.\u00a0 The lesson here is clear \u2013 a picture inspires the viewer to look backwards to the antecedent condition and forward to what it implies \u2013 and if lawyers don\u2019t control that the jurors will.<\/li>\n<li>Narrative involves time in two aspects \u2013 the time it takes to show\/tell the story, and the time within the story. As well, the sequencing of the narrative can generate causal thinking,<em>e<\/em>., that what happened first caused the next event in the chain. Abbott, 42.<\/li>\n<li>Three are \u201cmasterplots,\u201d and the closer a story is to a \u201cmasterplot\u201d that our culture imbues with values and \u201cidentity,\u201d the more credibility is assigned to it. The lawyer who can \u201cactivate [a] cherished masterplot\u201d can gain \u201crhetorical leverage\u2026\u201d\u00a0 Abbott, 46, 48.<\/li>\n<li>\u201cFocalizing\u201d is the point of view used to present information and detail. Selection of the right focalizer, at any point in the narrative, can convey thoughts and feelings to the audience.\u00a0 Abbott, 74.<\/li>\n<li>The character of an actor in the narrative is often imagined or reconfigured through \u201cpre-existing types that ew have absorbed from our culture and out of which\u2026we\u2026synthesize\u201d the character or something that stands for the character. Abbott, 117.<\/li>\n<li>Narratives ultimately build a multi-dimensional world, one of time and space, one \u201cinhabited by characters who have inner worlds of their own\u2026\u201d Narrative becomes the art of \u201cmaking and understanding a world.\u201d Abbott 164-165.<\/li>\n<\/ul>\n<p>Abbott\u2019s book is filled with more insight into narrative, and for lawyers has no better chapter than that titled \u201cnarrative contestation\u201d where he dissects the trial of Lizzie Borden, tried in 1893 for the axe-murders of her parents.\u00a0 <a href=\"https:\/\/famous-trials.com\/lizzieborden\">https:\/\/famous-trials.com\/lizzieborden<\/a> (last visited April 5, 2020).\u00a0 Abbott details the competing narratives of doting and murderous daughter, and how they emerge and reemerge across the trial.<\/p>\n<p>The upshot?
