{"id":2656,"date":"2020-03-20T14:42:31","date_gmt":"2020-03-20T18:42:31","guid":{"rendered":"https:\/\/www2.law.temple.edu\/aer\/?p=2656"},"modified":"2021-12-16T14:56:57","modified_gmt":"2021-12-16T14:56:57","slug":"the-memory-disconnect","status":"publish","type":"post","link":"https:\/\/law.temple.edu\/aer\/2020\/03\/20\/the-memory-disconnect\/","title":{"rendered":"THE MEMORY DISCONNECT"},"content":{"rendered":"<p>Anyone who thinks about the Law of Evidence knows that there are gaps between cognitive psychology and the rules we try cases by.\u00a0 Excitement may distort or inhibit perception, but we permit and rely upon excited utterances as statements valued for their sincerity <em>and<\/em> truth.\u00a0 The dangers of limiting instructions are clear \u2013 they sometimes exacerbate the impact of the problematic proof, yet we teach Rule 105 as a \u2018fix\u2019 to almost all risky evidence and then proceed under the myth that jurors will follow them to the \u201ct.\u201d<\/p>\n<p>Yet nowhere may the gap between what science teaches and what the law allows be greater than on the subject of memory.\u00a0 We regularly see lawyers \u2018refreshing memory\u2019 as if it really works and generates accurate recall.\u00a0 Science suggests otherwise.<\/p>\n<p>Rule 612 presumes the validity of using writings \u2013 even of third parties \u2013 to refresh witness memory.\u00a0 And a brief LEXIS search found no cases \u2013 except where hypnosis is involved &#8211; where a Court concluded that the refreshing process produced an unreliable [read \u201cinadmissible\u201d] memory.\u00a0 Yet this can\u2019t be correct.<\/p>\n<p>What do we know from memory science?\u00a0 Detail memory drops significantly within hours of an event; and how questions are asked (if the document was generated in an interview process) can itself create false memories. \u00a0\u00a0Consider the classic memory research, the car accident study of Elizabeth Loftus.<\/p>\n<p>What did she test?\u00a0 As described in one summary,<\/p>\n<p>7 films of traffic accidents, ranging in duration from 5 to 30 seconds, were presented in a random order to each group.<\/p>\n<p>After watching the film participants were asked to describe what had happened as if they were eyewitnesses.\u00a0 They were then asked specific questions, including the question \u201cAbout how fast were the cars going when they (smashed \/ collided \/ bumped \/ hit \/ contacted) each other?\u201d<\/p>\n<p>Thus, the\u00a0 [Independent Variable] was the wording of the question and the [dependent variable] was the speed reported by the participants<\/p>\n<p><a href=\"https:\/\/www.simplypsychology.org\/loftus-palmer.html\">https:\/\/www.simplypsychology.org\/loftus-palmer.html<\/a> (last visited 2-22-20).\u00a0 The findings were stark \u2013 as the word changed, the speed estimate changed as well.<\/p>\n<p><img decoding=\"async\" class=\"img-responsive srcset ezlazyloaded aligncenter\" src=\"https:\/\/www.simplypsychology.org\/loftus-results.jpg?ezimgfmt=rs:359x287\/rscb12\/ng:webp\/ngcb12\" alt=\"loftus and pamler 1974 results\" data-ezsrc=\"loftus-results.jpg?ezimgfmt=rs:359x287\/rscb12\/ng:webp\/ngcb12\" \/><\/p>\n<p>&nbsp;<\/p>\n<p>The suggestivity was not limited to analyzing what was actually seen; it extended to what was not seen but what was believed.\u00a0 One week later those who viewed the film were asked questions including \u201cDid you see any broken glass \u2013 yes or no?\u201d\u00a0 There was no broken glass in the filmed event.\u00a0 Those who were questioned with the more potent word\u00a0 &#8211; smashed \u2013 now had a new memory entirely:<\/p>\n<p><img decoding=\"async\" class=\"img-responsive srcset ezlazyloaded aligncenter\" src=\"https:\/\/www.simplypsychology.org\/loftus-results2.jpg?ezimgfmt=rs:403x115\/rscb12\/ng:webp\/ngcb12\" alt=\"loftus results of experiment two\" data-ezsrc=\"loftus-results2.jpg?ezimgfmt=rs:403x115\/rscb12\/ng:webp\/ngcb12\" \/><\/p>\n<p><em>Id.<\/em><\/p>\n<p>What does this mean? \u00a0\u00a0When lawyers read\/use interviews, they must understand that the interviewer may have had as much to do with the memory as the speaker.\u00a0 And how does this link back to refreshing recollection?\u00a0 It allows a technique that has serious problems:<\/p>\n<ul>\n<li>The doctrine permits refreshing no matter how many weeks, months or even years after the event the writing was created. So the refreshing document itself may be neither \u201cfresh\u201d nor accurate.<\/li>\n<li>No one will know how much of the original was suggested in the way the Loftus experiment demonstrated.<\/li>\n<li>Ultimately, it is impossible to tell if a memory has actually been refreshed, if the memory testified to in court is the memory of the event or the memory created when the document was prepared, or whether the witness is just agreeing that \u2018if it was on the paper I\u2019ll say it.\u2019<\/li>\n<\/ul>\n<p>There is a second lesson, one apart from the law of Evidence.\u00a0 That is teaching better interviewing technique.\u00a0 The lessons are being applied in law enforcement, where the process known as the Cognitive Interview produces more detailed and accurate statements from witnesses to crimes and as a result improving police crime solving.\u00a0 Satin and Fisher, ARTICLE: Investigative Utility of the Cognitive Interview: Describing and Finding Perpetrators, 43 Law &amp; Human Behavior 491(2019).<\/p>\n<p>How does the process work?\u00a0 And can lawyers use it?\u00a0 Both questions were answered 25 years ago, in Wydick, ARTICLE: THE ETHICS OF WITNESS COACHING, 17 Cardozo L. Rev. 1 (September, 1995).\u00a0 As a process, Wydick explains the four steps of the original cognitive interview process as a tool to be used by lawyers:<\/p>\n<ul>\n<li>Take the witness back to the scene, establishing context. This means placing the witness at\/in the scene by asking the person to visualize and feel it.<\/li>\n<li>Tell everything. Sorting facts into categories of \u2018important,\u2019 \u2018not so important,\u2019 and \u2018unimportant\u2019 can come later \u2013 first just let the details pour forth.<\/li>\n<li>Recall the event in different order (often from end back to beginning) or from the occurrence or observation that suck out the most.<\/li>\n<li>The event is then recalled from the perspective of various participants\/observers.<\/li>\n<\/ul>\n<p>17 Cardozo L.Rev. at 45-47.\u00a0 Wydick goes on to detail how the approach was then updated, with the interview process built around stages:<\/p>\n<ul>\n<li>Introduction, rapport building and making the witness comfortable.<\/li>\n<li>The open-ended narration stage.<\/li>\n<li>The probing stage \u2013 the repeat of the cognitive interview process, but now turning to each significant event or topic the witness offered during the narration.<\/li>\n<li>The review stage, one where the interviewed summarizes what has been learned and then sees if the witness recalls\/volunteers more.<\/li>\n<\/ul>\n<p>17 Cardozo L.Rev. at 47-50.<\/p>\n<p>How successful is the technique?\u00a0 Satin and Fisher report that \u201c[t]he CI has been tested in more than 100 laboratory and field studies in the United States, England, Australia, and Germany, and has been shown empirically to enhance witness recall, typically eliciting between 25 and 50% more correct statements than a standard police interview\u2026\u201d 43 Law &amp; Human Behavior at 492.<\/p>\n<p>And the takeaway for lawyers and judges?\u00a0 Unless we train on better interviewing technique, we will neither recognize which interviews have value for determining what occurred or for refreshing recall, nor ourselves elicit more accurate and necessary facts when we conduct interviews ourselves.<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Anyone who thinks about the Law of Evidence knows that there are gaps between cognitive psychology and the rules we try cases by.\u00a0 Excitement may distort or inhibit perception, but we permit and rely upon excited utterances as statements valued for their sincerity and truth.\u00a0 The dangers of limiting instructions are clear \u2013 they sometimes<\/p>\n","protected":false},"author":31,"featured_media":0,"comment_status":"closed","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"generate_page_header":"","_jetpack_memberships_contains_paid_content":false,"footnotes":""},"categories":[2,3,7,11],"tags":[],"coauthors":[238],"class_list":["post-2656","post","type-post","status-publish","format-standard","hentry","category-advocacy","category-advocacy-and-evidence-blog","category-evidence","category-trial-advocacy"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.2 -
