others have written that 10,000 hours of practice [rehearsal] are the <em>sine qua non<\/em> of moving on to expert status.\u00a0 See, e.g., BBC \u2013 Can 10,000 Hours of Practice Make You An Expert <a href=\"https:\/\/www.bbc.com\/news\/magazine-26384712\">https:\/\/www.bbc.com\/news\/magazine-26384712<\/a> (last visited 12-3-18).<\/p>\n<p style=\"text-align: center\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-medium wp-image-2273\" src=\"https:\/\/law-dev.temple.edu\/aer\/wp-content\/uploads\/sites\/3\/2018\/12\/Practice-doesnt-make-perfect.Practice-makes-permanentPerfect-practice-makes-perfect-300x106.png\" alt=\"\" width=\"300\" height=\"106\" srcset=\"https:\/\/law.temple.edu\/aer\/wp-content\/uploads\/sites\/5\/2018\/12\/Practice-doesnt-make-perfect.Practice-makes-permanentPerfect-practice-makes-perfect-300x106.png 300w, https:\/\/law.temple.edu\/aer\/wp-content\/uploads\/sites\/5\/2018\/12\/Practice-doesnt-make-perfect.Practice-makes-permanentPerfect-practice-makes-perfect-1024x360.png 1024w, https:\/\/law.temple.edu\/aer\/wp-content\/uploads\/sites\/5\/2018\/12\/Practice-doesnt-make-perfect.Practice-makes-permanentPerfect-practice-makes-perfect-768x270.png 768w, https:\/\/law.temple.edu\/aer\/wp-content\/uploads\/sites\/5\/2018\/12\/Practice-doesnt-make-perfect.Practice-makes-permanentPerfect-practice-makes-perfect-1536x540.png 1536w, https:\/\/law.temple.edu\/aer\/wp-content\/uploads\/sites\/5\/2018\/12\/Practice-doesnt-make-perfect.Practice-makes-permanentPerfect-practice-makes-perfect-2048x720.png 2048w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><\/p>\n<p>But research and common sense show otherwise.\u00a0 Everyone has seen the lawyer who chronically repeats bad habits and who we bemoan by saying \u201cwhen will she\/he ever learn?\u201d\u00a0 And a recent book makes the point that it is not practice but <em>deliberate <\/em>practice that makes a difference.<\/p>\n<p>The book is PEAK: SECRETS FROM THE NEW SCIENCE OF EXPERTISE by Anders Ericsson and Robert Pool (Mariner Books\/Houghton Mifflin 2017).\u00a0 Based on studies of musicians, athletes, people who develop the skill of memorizing remarkably long lists of randomly-selected numbers and others, the authors make clear that repetition is not the recipe for significant improvement.<\/p>\n<p>What is involved in <em>deliberate<\/em> practice and can it be translated to trial advocacy?<\/p>\n<p>At its simplest, especially for lawyers and lawyering, the basic steps are (1) determine the criteria for superior performance; (2) identify the expert performers in the field; (3) learn what makes them perform so well; and (4) identify training techniques that permit you to absorb their lessons and heighten the needed skills.<\/p>\n<p>Criteria, to this writer, should be something beyond win-loss records.\u00a0 Those may be as much a product of the field the lawyer litigates in, current popular sentiments, and the weakness of the opposition as they are of excellence.\u00a0 Instead, it is indisputably a skills-focused approach \u2013 the best opening, the best, direct examination, etc.<\/p>\n<p>And then?\u00a0 The authors posit the following as essential steps:<\/p>\n<ul>\n<li>Finding a coach or trainer who knows the expert performers\u2019 skills;<\/li>\n<li>Taking the practitioner\/student outside of a personal \u201ccomfort zone\u201d and go beyond \u201ccurrent abilities;\u201d<\/li>\n<li>Setting specific goals;<\/li>\n<li>A commitment of full attention and concentration;<\/li>\n<li>Feedback, monitoring and goal adjustment;<\/li>\n<li>Creating \u201cmental representations\u201d of the skill at issue and how best to implement it; and<\/li>\n<li>Ensuring that the new\/enhanced skills are built upon a foundation of core performance abilities.<\/li>\n<\/ul>\n<p>PEAK, 98-100.<\/p>\n<p><em>Deliberate<\/em> practice ultimately distinguishes knowledge from skill, with the emphasis on recurring performance.\u00a0 It is not \u2018telling\u2019 but \u2018doing\u2019 that raises the caliber of the performer.\u00a0 Drawing from research on continuing education for physicians, the authors note that those programs which involve \u201csome inter-active component \u2013 role-play, discussion groups, case-solving, hands-on training\u201d \u2013 were the most effective.\u00a0 PEAK, 134.<\/p>\n<p>The takeaways for lawyers\/litigators?\u00a0 Whether at the Law School level, where [hopefully] <em>deliberate<\/em> practice is at the core of any trial advocacy class; or once in practice, where CLE programs are the requisite of maintaining Bar status, lawyers need repeated hands-on training.\u00a0 And for those who litigate, perhaps yet another form of <em>deliberate<\/em> practice is to take the transcripts from trials and depositions and submit them for critical assessment followed by rethinking and recreating.\u00a0 Otherwise, we as lawyers are insane, at least as that has been defined\u00a0 in a quotation often attributed to Albert Einstein: Insanity is doing the same thing over and over again and expecting different results<\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Too many of us believe that if we do it [in the case of litigators, trying cases] enough, we will become good if not expert at our craft.\u00a0 Irving Younger preached the 20 jury trial threshold;
