{"id":2187,"date":"2018-08-20T15:48:10","date_gmt":"2018-08-20T19:48:10","guid":{"rendered":"https:\/\/www2.law.temple.edu\/aer\/?p=2187"},"modified":"2021-12-16T14:57:50","modified_gmt":"2021-12-16T14:57:50","slug":"when-character-is-the-winning-story","status":"publish","type":"post","link":"https:\/\/law.temple.edu\/aer\/2018\/08\/20\/when-character-is-the-winning-story\/","title":{"rendered":"WHEN \u201cCHARACTER\u201d IS THE WINNING STORY"},"content":{"rendered":"<p>The prohibition against using character \u2013 either explicitly, when we speak of a person\u2019s traits and tendencies, or indirectly, when we use other acts as a proxy to show character \u2013 is longstanding.\u00a0\u00a0 \u201cBy the turn of the nineteenth century, British and American courts were in agreement that prior act evidence introduced for the limited purpose of showing a defendant&#8217;s propensity to commit the charged offense should be excluded.\u201d\u00a0 <em>United States v. Caldwell<\/em>, 760 F.3d 267, 275 (3d Cir. Pa. 2014).<\/p>\n<p style=\"text-align: center\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-medium wp-image-2190\" src=\"https:\/\/law-dev.temple.edu\/aer\/wp-content\/uploads\/sites\/3\/2018\/06\/plotvcharacter-300x197.jpg\" alt=\"\" width=\"300\" height=\"197\" srcset=\"https:\/\/law.temple.edu\/aer\/wp-content\/uploads\/sites\/5\/2018\/06\/plotvcharacter-300x197.jpg 300w, https:\/\/law.temple.edu\/aer\/wp-content\/uploads\/sites\/5\/2018\/06\/plotvcharacter-768x504.jpg 768w, https:\/\/law.temple.edu\/aer\/wp-content\/uploads\/sites\/5\/2018\/06\/plotvcharacter.jpg 960w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><\/p>\n<p>&nbsp;<\/p>\n<p>Why?\u00a0 It is not that character has <u>no<\/u> relevance, but that it is likely to be overvalued.\u00a0 \u201cCharacter evidence is of slight probative value and may be very prejudicial. It tends to distract the trier of fact from the main question of what actually happened on the particular occasion. It subtly permits the trier of fact to reward the good man [or] to punish the bad man because of their respective characters despite what the evidence in the case shows actually happened.\u201d FRE Rule 404, Advisory Committee Note.<\/p>\n<p>But \u201ccharacter\u201d is core to the art of story-telling and is gleaned from what the individual does or fails to do.\u00a0 Aristotle wrote in the <em>Poetics<\/em> that \u201ccharacter determines men&#8217;s qualities, but it is by their actions that they are happy or the reverse. Dramatic action, therefore, is not with a view to the representation of character: character comes in as subsidiary to the actions.\u201d<\/p>\n<p>Can these two competing skeins \u2013 the ban on character to show action in conformity, and the need for the jury to find character as \u201csubsidiary to the actions[,]\u201d coexist?<\/p>\n<p>At a recent (May, 2018) Educating Advocacy Teachers conference, S. <em>Rafe Foreman<\/em><em>, <\/em>the Douglas Stripp Dean&#8217;s Distinguished Professor and Director of Advocacy at UKMC Law School<em>, <\/em>lectured on and demonstrated story-telling as a means for the jury to deduce the party\u2019s character.\u00a0 In Foreman\u2019s view, stories have a villain and a hero, and in the trial world the jury is the hero when it corrects a wrong or confirms the correctness of an action or decision.<\/p>\n<p>Because the typical story is built around morality and generating a strong like or dislike of one of the principals, Foreman advocates finding the actions that confirm the character trait the lawyer wants the jury to remember.\u00a0 The rest is in the telling \u2013 describing, or better yet portraying, acts that can lead to only one conclusion, that this person is villainous.<\/p>\n<p>In our workgroup, an attendee suggested the story of Judas as one with which the technique could be illustrated.\u00a0 Rather than using conclusory terms like \u201ccorrupt\u201d or \u201cvenal,\u201d Foreman had a volunteer act out Judas\u2019 meeting with the high priests.\u00a0 The volunteer asked \u201cwhat\u2019s in it for me,\u201d pocketed the money, and explained that the kiss would signal who the guards and crowd were to seize.\u00a0 The jury was left to draw its own conclusion, and it was inevitable \u2013 Judas had the character of being dishonest.<\/p>\n<p>Foreman posited another case, one where a surgeon left near the end of an operation and had subordinates finish sewing up the incision, an action that led to a severe injury.\u00a0 Foreman\u2019s story told what the surgeon did next \u2013 golfing.\u00a0 While the message in this instance is as powerful as that in the story of Judas, the relevance of where the physician went at the conclusion of surgery is questionable, and might be excluded by a judge because, of course, it sends a character message.<\/p>\n<p>The Evidence Professor in me complimented Professor Foreman, because when the actions to be depicted are intrinsic to the event(s) on trial, there is no conflict with 404(b) &#8211; we are not using other acts to show action in conformity.\u00a0 We are doing what lawyers have to do well \u2013 telling a story that will be emotionally compelling.\u00a0 The struggle will be with facts like the golf outing \u2013 will a judge find that intrinsic, or exclude it as propensity? \u00a0<span style=\"float: none;background-color: transparent;color: #333333;cursor: text;font-family: Georgia,'Times New Roman','Bitstream Charter',Times,serif;font-size: 16px;font-style: normal;font-variant: normal;font-weight: 400;letter-spacing: normal;text-align: left;text-decoration: none;text-indent: 0px;text-transform: none\">But that the person left before the job was done clearly comes in, and clearly damns the surgeon\u2019s character.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The prohibition against using character \u2013 either explicitly, when we speak of a person\u2019s traits and tendencies, or indirectly, when we use other acts as a proxy to show character \u2013 is longstanding.\u00a0\u00a0 \u201cBy the turn of the nineteenth century, British and American courts were in agreement that prior act evidence introduced for the limited<\/p>\n","protected":false},"author":31,"featured_media":0,"comment_status":"closed","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"generate_page_header":"","_jetpack_memberships_contains_paid_content":false,"footnotes":""},"categories":[2,3,11],"tags":[],"coauthors":[238],"class_list":["post-2187","post","type-post","status-publish","format-standard","hentry","category-advocacy","category-advocacy-and-evidence-blog","category-trial-advocacy"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.2 - https:\/\/yoast.com\/product\/yoast-seo-wordpress\/ -->\n<title>WHEN \u201cCHARACTER\u201d IS THE WINNING STORY - Advocacy and Evidence Resources<\/title>\n<meta name=\"description\" content=\"\u201cCharacter,\u201d found in acts or failures, is core to story-telling.
