{"id":1947,"date":"2017-05-30T09:51:48","date_gmt":"2017-05-30T13:51:48","guid":{"rendered":"https:\/\/www2.law.temple.edu\/aer\/?p=1947"},"modified":"2021-12-16T14:58:22","modified_gmt":"2021-12-16T14:58:22","slug":"disclosing-innocence-new-rule-professional-conduct","status":"publish","type":"post","link":"https:\/\/law.temple.edu\/aer\/2017\/05\/30\/disclosing-innocence-new-rule-professional-conduct\/","title":{"rendered":"DISCLOSING INNOCENCE \u2013 A NEW RULE OF PROFESSIONAL CONDUCT"},"content":{"rendered":"<p><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-1948 aligncenter\" src=\"https:\/\/law-dev.temple.edu\/aer\/wp-content\/uploads\/sites\/3\/2017\/04\/Innocence.jpg\" alt=\"\" width=\"236\" height=\"236\" srcset=\"https:\/\/law.temple.edu\/aer\/wp-content\/uploads\/sites\/5\/2017\/04\/Innocence.jpg 236w, https:\/\/law.temple.edu\/aer\/wp-content\/uploads\/sites\/5\/2017\/04\/Innocence-150x150.jpg 150w\" sizes=\"auto, (max-width: 236px) 100vw, 236px\" \/><\/p>\n<p>To some lawyers, it is not clear when the duty to correct errors from old cases expires.\u00a0 If you prosecuted a case in 2001, and learn of new evidence in 2017 that casts doubt on the conviction, must you notify anyone?\u00a0 And if you represented someone convicted long ago, or a witness, and now have information of innocence, is there an obligation to tell anyone?<\/p>\n<p>North Carolina has now provided an answer. \u00a0On March 16, 2017, the North Carolina Supreme Court adopted Rule 8.6, \u201cINFORMATION ABOUT A POSSIBLE WRONGFUL CONVICTION.\u201d\u00a0 Apparently only the second of its kind to impose an obligation on <em>all<\/em> counsel, not just prosecutors &#8211; and not all states impose this duty on prosecutors \u2013 it follows an earlier effort by Arizona.<\/p>\n<p>What is the requirement?<\/p>\n<p style=\"padding-left: 30px\">when a lawyer knows of credible evidence or information, including evidence or information otherwise protected by Rule 1.6, that creates a reasonable likelihood that a defendant did not commit the offense for which the defendant was convicted, the lawyer shall promptly disclose that evidence or information to the prosecutorial authority for the jurisdiction in which the defendant was convicted and to North Carolina Office of Indigent Defense Services or, if appropriate, the federal public defender for the district of conviction.<\/p>\n<p>Rule 1.6 is the Rule protecting \u201cconfidential\u201d information, <em>i.e.<\/em> information the lawyer obtained in connection with representing the client.\u00a0 So innocence trumps confidentiality.\u00a0 That, however, is not the same as \u201cprivilege.\u201d\u00a0 A later section of 8.6 specifically preserves the protection of attorney-client privileged communications.<\/p>\n<p>The Rule has a second exemption.\u00a0 A lawyer may not disclose information that would exculpate a convicted person <em>if<\/em> \u201cdisclosure would criminally implicate a current or former client or otherwise substantially prejudice a current or former client&#8217;s interests\u2026\u201d<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-1949 aligncenter\" src=\"https:\/\/law-dev.temple.edu\/aer\/wp-content\/uploads\/sites\/3\/2017\/04\/Model-Rules-of-Professional-Conduct-300x225.jpg\" alt=\"\" width=\"300\" height=\"225\" srcset=\"https:\/\/law.temple.edu\/aer\/wp-content\/uploads\/sites\/5\/2017\/04\/Model-Rules-of-Professional-Conduct-300x225.jpg 300w, https:\/\/law.temple.edu\/aer\/wp-content\/uploads\/sites\/5\/2017\/04\/Model-Rules-of-Professional-Conduct-1024x768.jpg 1024w, https:\/\/law.temple.edu\/aer\/wp-content\/uploads\/sites\/5\/2017\/04\/Model-Rules-of-Professional-Conduct-768x576.jpg 768w, https:\/\/law.temple.edu\/aer\/wp-content\/uploads\/sites\/5\/2017\/04\/Model-Rules-of-Professional-Conduct-1536x1152.jpg 1536w, https:\/\/law.temple.edu\/aer\/wp-content\/uploads\/sites\/5\/2017\/04\/Model-Rules-of-Professional-Conduct.jpg 2048w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><\/p>\n<p>So \u2013 is this meaningful given the exemptions?\u00a0 The answer is \u201cyes\u201d in two regards,\u00a0 The rule requires affirmative action, and specific parties who must be notified; and it uses a \u201creasonable likelihood\u201d standard which urges lawyers to err on the side of disclosure.\u00a0 This is a small but meaningful step in the move to redress wrongful incarceration;
