12•TEMPLEESQ.SUMMER2008Thecorerequirementforobtainingapatentisthattheinventionwasnotobviousatthetimeitwasinvented.Onlysignificanttechnologicaladvancesmeritawardofapatent.Thereasonsforthenon-obviousrequirementareevident:trivialadvanceswillbeachievedwithoutthenecessityofapatentincentive,andtrivialadvancesdonotbenefitsocietyenoughtowarrantimposingthecostsofapatentmonopolyonthepublic.Thoughthenon-obviousrequirementsoundslogical,asapplieditisirrational.Propernon-obviousdeterminationsareunachievablebecausetheyrequiretheuseofhindsight.Thedecisionshouldturnonwhethertheinventionwasnon-obviousintheexanteworldjustpriortotheinvention’screation.Apropernon-obviousdecisionmustnottakeintoaccounttheexpostfactthattheinventionwasactuallyachieved.Thepresentstudy,however,revealsthatpeoplearecognitivelyincapableofmakingsuchanevaluationproperly.Rather,decision-makersunconsciouslyletknowledgeoftheinventionbiastheirconclusionconcerningwhethertheinventionwasobviousinthefirstinstance.Thesefindingsaresupportedbyotherstudiesinbehavioraleconomicsandcognitivepsychologyoutsidethepatentcontext.Individualsareintellectuallyincapableofpreventinghindsightinformationfromimpactingtheirjudgmentsaboutthepast.Individualsroutinely(andunconsciously)overestimatewhatwouldhavebeenanticipatedinforesightandtendtoviewwhatactuallyoccurredashavingbeenrelativelyinevitableandforeseeable.Thehindsightbiasisrecognizedincommonwisdom:“hindsightis20/20,”andbeinga“Mondaymorningquarterback”exaggeratesone’sforesight.Thehindsighteffectisalsotreatedinlaw.Forinstance,itisthebasisforconcernthatknowledgeofasearchoutcome(whetherincriminatingevidencewasfound)willaffectjudgmentsconcerningwhethertherewasprobablecauseforthesearchinthefirstinstance.Thefailureofthelegalsystemtocorrectforthehindsightbiasinpatentlawlikelystemsinpartfromafailuretorecognizeitsmagnitude,pervasiveness,andunshakablenature.Theresultspresentedhereindicatethatthereisagreaterhindsighteffectfornon-obviousdeterminationsthanforotherlegaljudgments.Inonescenario,baseduponanactuallylitigatedpatent,approximatelyone-quarterofmockjurorsconsideredaninventionobviousintheforesightcondition(thedoctrinallyaccurateanalysis),whileaboutthree-quartersofmockjurorsconsideredthesameinventionobviousinhindsight(theconditioninwhichpatentdecisionsandlitigationactuallyoccur).Thiseffect(nearlyhalfoftherespondentsshiftedtheirlegalconclusioninhindsight)isgreaterthanthatfoundinotherlegalhindsightbiasstudiesinareasincludingnegligence,punitivedamages,andcivilrightslitigation.Asecondscenario,basedonadifferentpatentcase,similarlyfoundaverysubstantialhindsightbias:approximatelyone-thirdoftherespondentsshiftedtheirconclusioninhindsight.EXCERPTFROM“PatentlyNon-Obvious:EmpiricalDemonstrationthattheHindsightBiasRendersPatentDecisionsIrrational"byGregoryN.MandelOhioStateLawJournal,2006MANDEL...continuedfrompageoneHARVARDPROFESSORPRESENTSGREENLECTUREApril2,2008ProfessorEvelynB.HigginbothampresentedtheHonorableCliffordScottGreenLecture.HigginbothamistheVictorS.ThomasProfessorofHistoryandAfricanandAfricanAmericanStudiesatHarvardUniversity.SheisalsothechairoftheDepartmentofAfricanandAfricanAmericanStudiesandhasheldthispositionsince2006.PreviousspeakershavebeenJudgeTheodoreA.McKee,JudgeLouisH.Pollak,JudgeDamonJ.Keith,JudgeNathanielR.Jones,andProfessorDrewS.DaysIII.inventionsthatpresentedapparentlydisputablequestionsofnonobviousness.Each“juror”receivedonlyasinglescenarioinoneofthreedifferentconditions.Theforesight,orcontrol,conditionincludedallofthelead-upinformationandendedwiththescenariocharactertryingtosolvetheidentifiedproblem.Thehindsightconditionwasidenticaltotheforesightcondition,exceptthatithadoneadditionalconcludingsentencestatingthatthecharacterhadcomeupwithasolutionandidentifiedthatsolution.Thedebiasingconditionwasidenticaltothehindsightcondition,butthequestionsfollowingthescenarioincludedinstructionsbasedonModelPatentJuryInstructionsthatinformedthejurorofthehindsightproblem,warnedhimorheraboutit,andadvisedhimorhernottousehindsightinansweringthequestions.Inthequestionnaireattheendofthestudy,jurorswereaskedwhether,inlightofthepriorartandinformationprovidedinthescenario,asolutiontotheproblemwasobvioustoapersonwithordinaryskillintherelevantfield;theconfidencetheyhadintheiranswertotheobviousquery;andthelikelihoodthattheinventorinthescenariowouldachievetheinvention.“Becausetheonlythingthatvariedbetweentheforesightandhindsightconditionswasthepresenceofinformationconcerningachievementoftheinvention(thatis,becauseallotherfactorswerecontrolledfor),anydifferencesbetweentheforesightandhindsightgroups’responsescanbeattributedtothepresenceofthisinformation,”Mandellaterwrote.“Similarly,becausetheonlythingthatvariedbetweenthehindsightanddebiasingconditionswasthepresenceofthedebiasingjuryinstruction,anydifferencesbetweenthehindsightanddebiasinggroups’responsescanbeattributedtothepresenceofthisinstruction.”Mandel’sresultswerestriking,showing“thatthehindsightbiassignificantlyinfluencesnon-obviousjudgments.”“Participantswhowerenotinformedoftheinventionweresubst
